UNDER WORKMEN’S COMPENSATION ACT 1952

The Workmen’s Compensation Act 1952 was amended in August 1996.

under section 26(2) of the Amended Act, it is mandatory for every employer to insure all the foreign workers employed by him under an approved insurance scheme in respect of any liability he may incur under the Workmen’s Compensation Act 1952.

Any employer who fails to insure the foreign workers under the approved insurance scheme shall be quilty of an offence and shall be liable, on conviction, to a fine nFot exceeding RM20,000 or to imprisonment for a term not exceeding 2 years or both.

FOREIGN WORKERS COMPENSATION SCHEME (FWCS)

Under Section 26 the Workmen’s Compensation (Amendment) Act 1996, it is mandatory for Employers to insure all the foreign workers employed by them under the above Scheme.

SECTION 26 (1) COMPULSORY INSURANCE BY EMPLOYER
(Any liability which the employer may incur under this Act to his workman)
SECTION 26 (6) AN OFFENCE FOR FAILURE TO INSURE
(Fine not exceeding RM20,000.00 or 2 years imprisonment or both)
SECTION 13 (1) NOTICE TO COMMISSIONER BY EMPLOYER
(Employer must report to the labour office within 10 days of any accident to his workman)
SECTION 13 (5) AN OFFENCE FOR FAILURE TO REPORT
(Fine not exceeding RM 5,000.00 for 1st offence and not exceeding RM 10,000.00 for subsequent offences)

FWCS provides the benefit of coverage according to the Workmen’s Compensation Act 1952

DESCRIPTION OF COVER & BENEFITS
1. WORKMEN’S COMPENSATION
(a) Accidental Death or Permanent Disablement (During Working Hours) up to RM25,000.00
(b) Accidental Death or Permanent Disablement (After Working Hours) up to RM23,000.00
2. MEDICAL EXPENSES (Upon Receipt)
(a) Ward Charges, including Surgical Ward Treatment Fees up to RM300.00
(b) Operation Fees up to RM250.00
(c) X-ray Fee up to RM100.00
(d) Other Electric Therapatic Charges up to RM100.00

Total: up to RM750.00
3. REPATRIATION EXPENSES (Upon Receipt) up to RM4,800.00

REIMBURSEMENT OF LOSS OF WAGES
As Per Labour Assessment

FWCS CLAIM PROCEDURE

In the event of an accident covered under the FWCS:

  • Report the accident immediately to the Labour Department within 10 working days (applicable to employment accident only)
    (Failure to report the employment accident shall render the employer quilty of an offence under section 13(5) of the Act and shall be liable to a fine not exceeding RM5,000 for a first offence, and a fine not exceeding RM10,000 for any subsequent offence)
  • Report the accident immediately to UCN and seek advices from us for the claim processing.
